Terms of Service

1. Acceptance of Terms
By accessing or using the Traffic.Bar platform ("Service"), operated by TBAR MARKETING LIMITED, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
These Terms apply to all users of the Service, including advertisers, publishers, and any other visitors or users.
2. Description of Service
Traffic.Bar is a programmatic advertising network that connects advertisers with publishers across multiple ad formats including email ads, redirect traffic, push notifications, and member's area placements. The Service facilitates the buying and selling of digital advertising traffic.
Traffic.Bar acts as an intermediary marketplace. Publishers and advertisers are independent businesses. They are not employees, agents, partners or joint ventures of Traffic.Bar. Traffic.Bar does not create advertiser content, does not operate publisher properties, and does not itself send email or other messages to consumers. Each user remains solely responsible for its own conduct and its own legal compliance.
3. Account Registration
To use certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your account information to keep it accurate
- Maintain the security of your account credentials
- Accept responsibility for all activity that occurs under your account
- Notify us immediately of any unauthorized use of your account
4. Advertiser Terms
As an advertiser on the Traffic.Bar platform, you agree to:
- Comply with all applicable laws and regulations regarding your advertising content
- Ensure all campaigns and creative materials are truthful and not misleading
- Not promote illegal content, malware, or deceptive practices
- Maintain sufficient account balance to cover active campaign costs
- Accept that Traffic.Bar reserves the right to reject or remove any campaign at its sole discretion
5. Publisher Terms
As a publisher on the Traffic.Bar platform, you agree to:
- Only send legitimate, human traffic from your approved sources
- Not engage in or facilitate click fraud, bot traffic, or any form of artificial traffic generation
- Comply with all applicable laws regarding data collection and privacy on your properties
- Not misrepresent the nature, source, or quality of your traffic
- Accept that payments are subject to traffic quality verification and approval
5.1 Email traffic requirements
If you monetize email through the Service, all of the following apply. You must follow the Traffic.Bar Anti-Spam Policy, which forms part of these Terms. You may only send to recipients who gave prior, provable opt-in consent to receive commercial email from you or from the list owner you lawfully represent. Purchased, rented, scraped or harvested lists are prohibited.
You must keep consent records for each recipient (date, time, IP address, signup source URL and the consent text shown) for at least three years, and provide them to Traffic.Bar within five business days of a request. You must comply with all laws that apply to your sends, including the US CAN-SPAM Act, California Business and Professions Code section 17529.5, the EU GDPR and ePrivacy rules, and the anti-spam laws of every destination country.
Sending domains must be registered with accurate, publicly retrievable registrant information that identifies you or your sending entity; privacy or proxy registration is not permitted for sending domains. Header information must be accurate and subject lines must not mislead. Each email must identify the sender, include a valid postal address, and contain a working unsubscribe mechanism that you honor within ten days. You must apply advertiser suppression lists before sending. Traffic.Bar may use seed addresses and other checks to verify compliance.
5.2 Records, audit and disclosure
Traffic.Bar may request evidence of compliance with these Terms at any time, including consent records, sending domain lists and campaign logs. Traffic.Bar may disclose your identity and your compliance records to an affected advertiser, a court, a regulator or another authority where the law requires it, or where reasonably necessary to respond to a complaint or claim arising from your traffic.
6. Prohibited Activities
You may not use the Service to:
- Violate any applicable laws or regulations
- Generate or distribute fraudulent, bot, or incentivized traffic
- Promote malware, spyware, or any harmful software
- Infringe upon intellectual property rights of others
- Engage in any activity that interferes with or disrupts the Service
- Attempt to gain unauthorized access to any part of the Service
- Use the Service for money laundering or financing illegal activities
- Depict, reference, sexualize, or target minors in any creative, landing page, or funnel, including AI-generated or synthetic imagery (see Section 7)
7. Age Restriction & Child Safety
The Service is strictly limited to adults aged 18 years or older, or the higher legal age of majority in your jurisdiction. By accessing or using Traffic.Bar, you represent and warrant that you meet this requirement.
Traffic.Bar enforces a zero-tolerance policy on child sexual abuse material (CSAM) and on any content that depicts, references, implies, or is designed to appeal to minors, including AI-generated or synthetic imagery. This clause is material to this agreement and survives termination.
As a condition of using the Service:
- Publishers must implement meaningful age verification on every property routing traffic through Traffic.Bar and must block users under 18.
- Advertisers may not submit creatives, copy, landing pages, or funnels that feature, imply, or are intended to appeal to any individual under 18, including AI-generated content suggesting minors.
- Dating, adult, and relationship offers must serve adult audiences only and must include appropriate age verification on their destination platforms.
- Enforcement. CSAM or underage-targeted content results in immediate account termination without prior notice, forfeiture of all pending balances, preservation of evidence, and reporting to NCMEC, INHOPE, and competent law-enforcement authorities in the relevant jurisdiction. Traffic.Bar cooperates fully with investigations.
- Reporting. Suspected CSAM or underage content should be reported to abuses@traffic.bar. Good-faith reports are reviewed within 24 hours with confidentiality for the reporter.

8. Payments and Billing
Payment terms vary based on your account type and agreement. Traffic.Bar reserves the right to withhold payments if fraudulent activity is detected. All fees are non-refundable unless otherwise stated in writing or provided for in the applicable Advertiser Terms and Conditions. Payment disputes must be raised within 30 days of the transaction date.
9. Fraud Prevention
Traffic.Bar employs a zero-tolerance policy toward fraud. We actively monitor all traffic and reserve the right to suspend or terminate accounts, withhold payments, and take legal action against any user found to be engaging in fraudulent activities. Our fraud detection systems operate continuously, and decisions made by our anti-fraud team are final.
If Traffic.Bar reasonably determines that traffic breached these Terms or the Anti-Spam Policy, Traffic.Bar may reject or reverse the earnings related to that traffic, withhold amounts that reasonably correspond to the non-compliant traffic, and set off documented losses that Traffic.Bar suffers as a direct result of the breach against the user's account balance. Traffic.Bar will inform the user and, on request, explain the determination.
10. Intellectual Property
The Service and its original content, features, and functionality are owned by Traffic.Bar and TBAR MARKETING LIMITED and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without prior written consent.
11. Limitation of Liability
To the maximum extent permitted by law, Traffic.Bar and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.
Traffic.Bar's total aggregate liability under these Terms, for all claims combined, shall not exceed the total fees paid by the advertiser to Traffic.Bar, or the total amounts payable by Traffic.Bar to the publisher, in the three months before the event giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Traffic.Bar, TBAR MARKETING LIMITED, and their officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
This indemnity includes, without limitation, claims, regulatory actions, fines and third party demands relating to unsolicited communications, missing or invalid consent, misleading header information or subject lines, data protection violations, or other unlawful conduct in traffic you supplied or campaigns you ran. This indemnity survives termination of these Terms.
13. Modifications to Terms
Traffic.Bar reserves the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
14. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive.
The provisions on email traffic requirements, records and disclosure, earnings reversal and set off, limitation of liability, indemnification and governing law survive termination.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Cyprus, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Limassol, Cyprus.
